Loan Terms and Conditions

1. Introduction
Welcome to Atlantian Trust Loan Firm. These terms and conditions (“Terms”) govern the loan services provided by us. By applying for a loan, you agree to abide by these Terms.
2. Loan Application
2.1. Eligibility: To be eligible for a loan, you must be at least 18 years old, a resident of the European Union, and meet our credit criteria.
2.2. Application Fee: A non-refundable application fee of €100 is required upon submission of your loan application.
2.3. Documentation: You must provide all necessary documentation, including proof of income, identification, and other relevant information as requested.
3. Loan Approval
3.1. Approval Process: Loan approval is subject to a thorough review of your application and supporting documents. Approval is at our sole discretion.
3.2. Notification: You will be notified of the loan approval status within Five business days after submission of your complete application.
4. Interest Rates
4.1. Standard Interest Rate: The standard interest rate for loans is based on the prevailing European Central Bank (ECB) rates, plus a margin. As of August 2024 the ECB rate is 4.25%.
4.2. Margin: An additional margin of 2% will be applied to the ECB rate, resulting in a total interest rate of 6.25%.
4.3. Rate Changes: Interest rates are subject to change based on ECB rate adjustments. Any changes will be communicated to you in writing at least 30 days prior to taking effect.
5. Loan Terms
5.1. Loan Amount: The minimum loan amount is 1000.
5.2. Repayment Period: The standard repayment period ranges from 12months to 84months.
5.3. Repayment Schedule: Repayments are to be made monthly. A detailed repayment schedule will be provided upon loan approval.
6. Fees and Charges
6.1. Mandatory Loan Insurance
The Borrower agrees to obtain and maintain, at their own expense, a loan insurance policy covering the full amount of the loan (hereinafter referred to as the “Loan Insurance”). This policy shall be obtained from an insurance company selected and approved by the Atlantian Trust.
6.2. Selection of Insurer
Atlantian Trust shall have the sole discretion to designate the insurance company from which the Loan Insurance must be purchased. The Borrower shall not procure Loan Insurance from any other insurance provider without the prior written consent of Atlantian Trust.
6.3. Proof of Insurance
The Borrower shall provide Atlantian Trust with a certificate of insurance or other proof of coverage within a specified time period from the date of the Agreement or as otherwise required by Atlantian Trust. The Borrower must ensure that Atlantian Trust is named as the loss payee or beneficiary on the Loan Insurance policy.
6.4. Compliance
The Borrower shall comply with all terms and conditions of the Loan Insurance policy and shall be solely responsible for the payment of all premiums, fees, and other costs associated with maintaining the insurance coverage.
6.5. Late Payment Fee: A late payment fee of €25 will be charged for any payment not received by the due date.
6.6. Early Repayment Fee: Early repayment is allowed. An early repayment fee of 3% of the outstanding balance will apply if the loan is paid off before the end of the term.
7. Default
7.1. Default Conditions: You will be in default if you fail to make any scheduled payment, breach any terms of this agreement, or if any provided information is found to be false.
7.2. Consequences of Default: In the event of default, the full loan amount may become immediately due and payable. We reserve the right to take legal action to recover the debt.
8. Data Protection
8.1. Privacy Policy: We are committed to protecting your privacy. All personal data collected will be handled in accordance with our Privacy Policy, available at atlantiantrust.com.
8.2. Data Use: Your personal data will be used for processing your loan application and managing your account.
9. Governing Law
These Terms are governed by the laws of European Union (EU). Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ireland.
10. Amendments
We reserve the right to amend these Terms at any time. Any changes will be communicated to you in writing at least 30 days before they take effect.
